NeuroJustice – A Groundbreaking Exploration of Law, Functional Neurosciences, and Disability Compensation
Our forthcoming book, Neuro Justice, presents a compelling intersection of clinical neuroscience, legal responsibility, and ethical restitution. Drawing on over 15 years of experience and over 2000 court appearances, Dr. Sharan Srinivasan and Dr. Prathiba Sharan have been actively involved in providing expert medical testimony in courts, particularly in cases of motor vehicle accidents resulting in neurological disability. They are also faculties at the Karnataka Judicial Academy and have trained over 600 judges about assessing neurological disabilities for the purpose of awarding ‘Just’ compensation.
Patients who sustain brain or spinal injuries often face long-term or permanent neurological deficits that affect their ability to function and earn a livelihood. The role of the expert neurosurgeon becomes vital in court proceedings, as compensation awarded by motor vehicle insurance claims hinges on the accurate, case-specific assessment of the patient’s ‘functional and ‘avocational’ disability/s.
Unlike orthopedic injuries, neurological disabilities are nuanced, multifaceted, and often lack standardized quantification tools. This complexity makes it imperative to provide individualized, evidence-based evaluations that consider not just clinical deficits, but also the patient’s cognitive abilities, vocational background, educational level, and socio-economic context.
Neuro Justice aims to educate a wide range of stakeholders—including petitioners, advocates, insurance representatives, judicial authorities, patients, and caregivers—on the importance of comprehensive disability assessment and robust medico-legal documentation. Only through informed evidence and a just process can individuals who have suffered neurological impairments receive fair and rightful compensation for their losses, especially the loss of future income and quality of life.
This book is a step toward bridging the critical gap between neuroscience and justice.
